CHANGES IN WORKERS' COMP LAW SPEED UP HEARING PROCESS
By Wayne J. Studer
August 2011
As of August 1, 2011 all workers' compensation claims filed in Minnesota on or after this effective date are guaranteed a hearing before a compensation judge within nine months. This change in law updates the previous length of wait, which ranged between 12 to 14 months. Expedited conferences and hearings are still available for those seeking resolution for denied medical treatment and/or bills, denied rehabilitation benefits, or a proposed discontinuance of wage loss benefits. To avoid delays, any requests for continuance are now granted only for "good cause" and only with a client's written consent.
